Terms of Service

These terms are an agreement between you and Monstar Lab Pte Ltd (“MonstarX”, “we”, “us”) about your use of MonstarX: the website at monstarx.com, the app builder, the hosting of published apps and the related services. By creating an account or using MonstarX, you agree to these terms and to our Privacy Policy. If you use MonstarX for an organisation, you agree on its behalf and confirm you are allowed to do so.

01Your account

You must be at least 16 to use MonstarX, and old enough to form a binding contract where you live to buy a paid plan. Give us accurate details, keep your password safe, and tell us straight away if you think someone else has used your account. You are responsible for what happens in your account.

An account is for one person. Don’t share it, and don’t open several accounts to get around usage limits.

02What MonstarX does

MonstarX uses AI models to plan, write, test and publish web apps from your descriptions. It hosts previews and published apps, gives each app services such as a database, accounts, email, file storage and AI, and lets you connect third-party services, save to GitHub and buy domains.

We keep improving MonstarX, so features, models and limits change over time. Some features may be marked as early or experimental, and may change or be removed. If we remove something important that you pay for, we will tell you in advance.

03What you own

As between you and us, you own your content: your prompts and messages, the files you upload, the code MonstarX generates for your projects, your apps and the data they hold. We don’t claim ownership of any of it.

You give us a worldwide, non-exclusive licence to host, copy, process, transmit and display your content only as needed to run MonstarX for you. This includes sending it to the AI model providers and other service providers described in our Privacy Policy. The licence ends when you delete the content, except for copies we must keep by law and backups that expire on their normal schedule.

Each app also includes code MonstarX provides, such as its starter files and the managed helpers for MonstarX’s services. You may use, change and deploy that code as part of your app, including after you export the app or leave MonstarX. MonstarX itself (the builder, its brand and its technology) remains ours.

You confirm that you have the rights to everything you give MonstarX, and that using it with MonstarX doesn’t infringe anyone else’s rights.

04AI-generated output

AI can make mistakes. Generated code, text and pictures may be wrong, incomplete, insecure or similar to what others receive. Automated QA and security scans help find problems, but they don’t guarantee that an app is correct, secure or legally compliant.

Review and test your apps before you rely on them or give them to others, especially where money, health, safety or personal information is involved. You are responsible for how you use the output.

05Acceptable use

Don’t use MonstarX, or the apps you build and host with it, to:

  • break any law, or infringe anyone’s intellectual property, privacy or other rights;
  • deceive people, for example through phishing, collecting passwords or payment details under false pretences, impersonating a person or organisation, or running scams;
  • create or spread malware, or attack, probe or overload any system, including MonstarX and the services it uses;
  • send spam or unsolicited bulk email through your apps’ email;
  • harass, threaten or harm people, promote violence, or share sexual content involving minors;
  • mine cryptocurrency, or use previews and hosting for anything other than building and running your apps;
  • get around usage limits, access controls or security measures, or access other people’s projects or data without permission;
  • resell or give others access to MonstarX itself, or copy it to build a competing service;
  • generate content that breaks the usage policies of the AI model providers that answer your requests.

If we believe content or an app breaks these rules, we may remove it, take the app offline, or limit or suspend your account. Where it is reasonable, we will tell you first and give you a chance to fix the problem.

06Your apps and their users

You are the provider of the apps you publish. You are responsible for them and for your relationship with their users, including your own terms and privacy policy, compliance with consumer, privacy, accessibility and other laws, and handling your users’ requests and complaints.

We store and process your users’ data only to run your app for you, as described in our Privacy Policy. Published apps are served from monstarx.app addresses or the domains you connect. We may take down an app that breaks these terms or puts people, systems or MonstarX at risk.

07Third-party services

MonstarX works with other services, such as sign-in providers, code repositories, payment services, AI model providers and the connectors you add to your apps. When you use them, their own terms apply as well, and you are responsible for the accounts and keys you connect. We aren’t responsible for other companies’ services, but we choose the ones we rely on with care.

08Plans, payments and usage limits

Plans, prices and what each plan includes are shown on our pricing page. Prices are in US dollars and exclude tax, which is added where it applies. Payments are handled by our payment processor.

  • Renewal. A paid plan is billed monthly in advance and renews automatically until you cancel.
  • Cancelling. Cancel at any time in Settings. You keep your plan until the end of the period you paid for, then your account moves to the Free plan. Your projects and apps stay.
  • Changing plans. Upgrades and downgrades take effect straight away, and the price difference is prorated.
  • Usage limits. Each plan has usage allowances, which reset over the periods shown in MonstarX. Unused allowance doesn’t carry over. When you reach a limit, you can wait for it to reset, upgrade, or use a Boost.
  • Boosts. Boosts are one-time purchases that reset your current plan’s allowances when you use them.
  • Failed payments. If a payment fails, we will retry it and let you know. If it still can’t be collected, your account may move to the Free plan.
  • Price changes. We will give you at least 30 days’ notice of a price increase for your plan. It applies from your next renewal after that, and you can cancel before it takes effect.

Except where these terms or the law say otherwise, payments are non-refundable, including for partial months and unused allowances or Boosts. This doesn’t limit your rights under the Australian Consumer Law or other consumer laws that apply to you. If something went wrong, write to us and we will look at it fairly.

We may change the Free plan and its limits at any time.

09Domains

Domains you buy through MonstarX are registered through our domain registrar partner for the period shown when you buy them, and are subject to the rules of the registrar, the registry and ICANN. The price is shown before you pay. If a registration fails, your payment is refunded.

We remind you before a domain expires. It is your responsibility to renew it. If it expires, it may be lost, and someone else may register it. You can ask us to transfer a domain you bought through MonstarX to another registrar.

10Feedback

If you send us ideas or feedback, we may use them to improve MonstarX without paying you or giving you credit. You don’t have to send any.

11Ending your use of MonstarX

You can stop using MonstarX at any time. You can cancel your plan in Settings and ask us to close your account by writing to us.

We may suspend or close your account if you seriously or repeatedly break these terms, if you don’t pay, if the law requires it, or if your use puts other people or the service at risk. Unless the reason makes it inappropriate (for example, fraud, abuse or a legal requirement), we will give you notice and a reasonable chance to export your projects first. If we stop offering MonstarX altogether, we will give you at least 30 days’ notice and refund any fees you paid for the time after it stops.

Sections that are meant to continue after your account ends, such as what you own, disclaimers, liability and the governing law, continue to apply.

12Disclaimers

We work hard to keep MonstarX reliable, but it is provided “as is” and “as available”. To the extent the law allows, we make no promises beyond those in these terms: in particular, we don’t promise that MonstarX will be uninterrupted or error-free, or that generated output will suit your purpose.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those guarantees or any other rights that cannot be excluded by law. Where the law allows us to limit our liability for failing to meet such a guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.

13Limitation of liability

To the extent the law allows, neither you nor we are liable for indirect or consequential loss, or for loss of profits, revenue, data or goodwill, arising from these terms or from MonstarX.

To the extent the law allows, our total liability to you for all claims related to MonstarX is limited to the greater of the amounts you paid us in the 12 months before the claim arose and AUD 100.

These limits don’t apply to liability that cannot be limited by law, such as for fraud.

14Your responsibility for claims

If someone makes a claim against us because of your content, your apps, or your breach of these terms or the law, you will cover our reasonable costs and losses from that claim, except to the extent we caused them.

15Changes to these terms

We may update these terms as MonstarX changes. The date at the top shows when they last changed. If a change significantly affects you, we will tell you by email or in MonstarX at least 14 days before it takes effect, unless it has to take effect sooner for legal or security reasons. If you don’t agree to a change, you can stop using MonstarX and cancel your plan before it takes effect.

16General

These terms are governed by the laws of New South Wales, Australia, and both of us submit to the courts of New South Wales. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live, and you may bring claims in its courts.

These terms and our Privacy Policy are the whole agreement between you and us about MonstarX. If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a right straight away, we haven’t given it up. You may not transfer these terms without our consent. We may transfer them to a company that takes over MonstarX, and we will tell you if we do.
